When Forest and Everton submitted updated accounts in December of last year, which included the 2022–23 season, they were both charged with violating the Profit and Sustainability Rules (PSR) in January.

The Toffees were already fined for a previous spending violation, but this week an appeal resulted in the 10-point reduction being lowered to six points since the original commission made two “legal errors” in imposing the first penalty.

Sean Dyche’s team is eager to argue that, having already been punished for infractions committed between 2019 and 2023, they shouldn’t be put through “double jeopardy” as they await the outcome of their most recent accusation.

However, Stefan Borson was eager to refute the main defense put out by Everton because the most recent infraction represented a concerning “trend” for the team.
