who died weeks after Sept. 1 confrontation with former Detroit Police Officer Juwan Brown outside the Garden Bowl on Woodward in Detroit’s Cass Corridor. The lawsuit, which was filed in U.S. District Court for the Eastern District of Michigan, names as defendants Brown, the city of Detroit and Detroit Police Sgt. Jarmiare McEntire.

Harrington said. “What former Officer Brown did to Mr. Vance was nothing short of reckless and malicious police brutality.” The lawsuit accuses McEntire of violating Vance’s civil rights the day after the assault “by conducting an illegal, warrantless search of his apartment on Sept. 2, 2023, under the guise of a ‘investigation, where no exception to the warrant requirement to the Fourth Amendment to the United States Constitution existed,'” said the 72-page complaint.

Detroit Corporation Counsel Conrad Mallett declined to comment, citing the city’s policy to not discuss ongoing litigation. Brown, 29, was charged with manslaughter in connection with Brown’s death, although 36th District Court Judge Kenneth King determined after a preliminary examination last month that there wasn’t enough evidence to bind the case over for trial. Wayne County prosecutors said they plan to appeal King’s ruling.

According to Brown’s body-worn camera, the officer approached Vance outside the bowling alley, and Vance asked the officer to identify himself. “Officer Brown then pushed Vance in the stomach and said, ‘These kind people don’t want you here, so you got to go,'” the lawsuit said, quoting the audio from Brown’s body-worn camera. “Upon information and belief, the push by … Officer Brown caused an already agitated and upset Vance to start yelling profanities at Officer Brown.” After the argument escalated, Brown punched Vance in the temple, causing him to fall and hit his head on the sidewalk, the lawsuit said. “Vance was conscious for a period of time as he lay on the sidewalk, before becoming unconscious from the deadly blow,” the lawsuit said.
